What's in these terms?
This acceptable use policy sets out the content standards that apply when you upload, enter or edit content on the elevate.io software, platform(s), website(s), application(s) or services (the elevate.io Services), use any of the collaboration features on the elevate.io Services, or interact with the elevate.io Services in any other way. It should be read alongside the elevate.io Terms and Conditions.
Publishing video content to the Spark Services
The elevate.io Services enable you to publish video content to the Spark Services. If you choose to do so:
You must ensure that the video content complies with the Spark Content Standards Policy.
You should note that the Spark Contents Standards Policy is more restrictive than this elevate.io Acceptable Use Policy.
Therefore you cannot assume that if your user content is permitted on the elevate.io Services it will be permitted on the Spark Services.

Prohibited uses
You may not use elevate.io Services:
In any way that breaches any applicable local, national or international law or regulation.
In any way that is unlawful or fraudulent or has any unlawful or fraudulent purpose or effect.
To send, knowingly receive, upload, download, use or re-use any material which does not comply with our content standards.
To transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam).
To knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware.
In any way that involves child sexual exploitation or abuse.
In any way that involves modern forms of slavery, human trafficking, sex trafficking or other illegal exploitation.
You also agree:
Not to reproduce, duplicate, copy or re-sell any part of the elevate.io Services in contravention of the provisions of our Terms and Conditions.
Not to access without authority, interfere with, damage or disrupt:
any part of the elevate.io Services;
any equipment or network on which any of the elevate.io Services is stored;
any software used in the provision of the elevate.io Services; or
any equipment or network or software owned or used by any third party.
Content standards
These content standards apply to any and all material which you upload, enter, edit or otherwise contribute to the elevate.io Services (Material).
We will determine, in our discretion, whether any Material breaches these content standards.
Material must comply with the law applicable in any country from which it is posted and to which the website is targeted.
Material must not:
Include child sexual abuse material or content relating to the sexual exploitation or other abuse of children.
Include any material that involves modern forms of slavery, human trafficking, sex trafficking, illegal immigration, sexual exploitation or other illegal exploitation.
Include content that would be considered a criminal offence under laws relating to terrorism, child sexual abuse material, racism or xenophobia.
Include terrorist content which includes content encouraging terrorism, training for terrorism, making terrorist threats, content supporting a terrorist organisation and content from a terrorist organisation.
Infringe any copyright, database right or trademark of any other person.
For the avoidance of doubt, for any Material in the form of video content:
You must tell us if you upload a video in breach of this acceptable use policy.
You must tell us immediately if you upload a video containing any material relating to terrorism, sexual exploitation of children, child pornography, racism and xenophobia, modern forms of slavery, human trafficking, sex trafficking or other illegal exploitation.
Fair use limits
The elevate.io Services and Spark Services (collectively, the Services) are currently available free of charge. To make this work, we need to ensure that the Services are used in a way that is proportionate and does not unfairly take advantage of the free model.
We may impose usage limits, traffic limits, storage limits or other limits on the use of the Services in our sole discretion, and may suspend or terminate access in excess of those limits. These limits may be imposed automatically or manually.
If we request that you modify your use of the Services in order to comply with any limits, you must do so within the timescale we specify (or, failing that, within a reasonable period of time). If you fail to do so, that shall be deemed to be a breach of this policy.
Breach of this policy
When we consider that a breach of this Acceptable Use Policy has occurred, we may remove user content, suspend or ban you, or restrict your use of the Services.
To the maximum extent permitted under relevant laws:any part of the elevate.io Services;
we exclude our liability for all action we may take in response to breaches of this Acceptable Use Policy; and
the actions we may take are not limited to those described above or in our Terms and Conditions, and we may take any other action we reasonably deem appropriate.
Publishing content to the Spark Services
If you choose to publish any content to the Spark Services, then the following provisions shall apply:
Our Spark Content Moderation and Complaints Policy shall apply in relation to such content. Our Spark Content Moderation and Complaints Policy explains how we handle complaints and moderate user content on the Spark Services, including how we deal with terrorist content, child sexual abuse material, other priority illegal content, other illegal content and content on the Spark Services which is against the law or which is in breach of the Terms and Conditions, including this Acceptable Use Policy.
Our Spark Content Moderation and Complaints Policy also explains what actions you can take if you disagree with a decision we have made in relation to your user content on the Spark Service.
In the event of any conflict between this section (i.e. the provisions under the heading “Publishing content to the Spark Services”) and the information elsewhere in this Acceptable Use Policy, this section shall take priority.
